Ricebrnr- Although its evident your moved by this short story, I'm not certain you are aware of what your saying. It would be quite difficult for a vehicle to engage in the act of "battering" someone, or for endangerment to be "reckless". Did you read the article, or just the headline? All we know is this: a man was involved in a crash, alcohol was found in his system. Do we know if he "caused" the crash? No, granny smith may have struck him from behind causing a fender bender, in which case a "accident" still had to be formally reported. So by your standards should we also send to prison every responsible adult that consumes 2 drinks at dinner with their family and happens to be unlucky enough to be caught? Do they deserve prison for simply because they were spotlighted?

i read the law last week and believe for minors it's over.02. I'm sure they give them a little wiggle room because of mouthwash and things like that.

Don't forget to confiscate the vehicle and the driver's license for life!!

It is illegal to provide alcohol to minors and I hope whoever gave this kid the booze looses their liquor license (a store) or goes to jail (a private citizen.) Its time we start enforcing the laws and holding people accountable for their actions.

MIP includes a minor whose PBT registers anything above.000 (I believe). Minors are not supposed to be ingesting alcohol. There's nothing in the story that says this person bought the alcohol. It might have been given by a friend. Question: Don't the cops have to hold someone who has a blood alcohol over the legal limit for some number of hours before release?

1201SouthMain, I have heard of teenagers being arrested coming over the border from Canada when they blew more than something like.04%, with the reason being the alcohol was on their person; specifically IN their person. I assume the same applies for domestic traffic stops.

It's trivial but I thought there had to be a witness to a MIP. So unless he had alcohol in the vehicle, I don't think he could be charged with a MIP. I'm not in law enforcement and could definitely be wrong. Does anyone know for sure?

@Malorie, thank you for getting out my jest. I love to see how anti freedom, anti rights people that argue so vehemently against our rights trip all over themselves when that same logic is applied to rights they care about.

@zollar - ricebrnr was alluding to the anti-gun arguments that have been made recently in comments on other articles. @clara - charges were still pending. I'm sure one of those charges will be for underage drinking and/or MIP.

Ricebrnr, you cannot not go and prosecute the retail store ( if that is where he bought his spirits) Learn the LAW

Released?!?!? I hope some of those charges pending include reckless endangerment and assault and battery with a deadly weapon. I also hope that his license will be revoked for life. Just to be safe I hope we track down where this person got their liquor and prosecute them for the same!
