Appeals court sets date for arguments on whether Hutaree militia members should be released
A federal appeals court wants to hear arguments before deciding whether to release five Hutaree militia members from jail until trial.
In an order Tuesday, the 6th U.S. Circuit Court of Appeals set arguments for June 8 in Cincinnati.
A federal judge in Detroit has said the five could go home with electronic monitors and other strict conditions. Federal prosecutors are appealing that order. Meantime, the five remain locked up.
They are charged with conspiracy to commit rebellion against the United States and other crimes. Four additional defendants were released from jail last week.
The militia is called Hutaree (who-TAH'-ray) and is based in Michigan's Lenawee County. The nine defendants are from Michigan, Indiana and Ohio.

I will be interesting to see what argument the prosecutors can present differentiating these remaining 5 against the 4 that were already released. My guess is they will present a weak argument and hope the defense attorneys are even lamer. The remaining 5 will then be released also on the same grounds that the 32 page ruling of several weeks ago covered. Can't wait to see the actual trial. It's going to be a debacle.
