Michael Radant, the 37-year-old co-owner of a downtown Chelsea eatery charged with two counts of third-degree criminal sexual misconduct, had his case bound over to circuit court after a preliminary examination in the 14A-1 District Court Tuesday, his attorney Brian Montoye said.

The 37-year-old woman who made the allegations was the only person to testify at the exam, Montoye said. Judge Richard Conlin found there was probable cause that a crime occurred and that Radant was responsible and bound the case over to the higher court.

A pretrial hearing date was set for Jan. 10 in Judge David Swartz's courtroom, according to court records.

"The case is proceeding along," Montoye said.

He had no additional comment about the matter.

The 37-year-old woman told police Radant sexually assaulted her at a residence in the 700 block of North Main Street on Nov. 15. The two were acquainted for some time, police said. The woman came into the Chelsea Police Department to report the incident on Friday.

Police did not go into much detail about the incident. Third-degree criminal sexual conduct involves both force and penetration, Toth said.

Radant is the co-owner of Ellie’s Chelsea, a burger and sandwich shop located at 312 N. Main St. in the Clocktower Commons in Chelsea.

Hi Marilyn: Here's the link to a story we did earlier this year on the restaurant that lists Radant as a co-owner.

Things change. Business expanded. Ownership changed. You could have checked with Ellie's to get it right before putting the business into print. Brother Steve no longer co-owner either. Check first next time.

Please check your facts. Mike Radant is an employee at Ellie's, not a co-owner. Time for you to stop mentioning the business.

It is matter matter of Bussiness,AMD public record that he is co-owner. Maybe you should check you facts! Should it affect the business no,but lying isn't going to change the facts.

Both 37 years old, the two were acquainted for sometime? Both adults, but seems like she could have gotten out of the situation. I guess somebody will have to go into more detail.

The article stated they were acquainted for quite some time, not in a relationship. Chelsea is a very small town and many people and families have lived there for generations. That being said who would you like to have go into more detail? The victim? You assumed there was a "situation" to get out of. Would that be their long time friendship? Think about that and while you're at it think about what assumptions can to a victim.

I think his attorney is Brian Montoye not Michael.

It sounds like this will go to 12 jurors to hear the entire story. Can't be good for the family business. The story never mentioned if alcohol or hard drugs were involved.
