By Cindy Heflin

Milan police said they discovered 66 containers of marijuana in the basement of a Milan house where a home invasion led to a fatal shooting last month, the Milan News-Leader reported.

Police execute a search warrant at a home in Milan following a home invasion and fatal shooting.

Robert Goupill, 50, who has been charged with manslaughter in the shooting, is a licensed medical marijuana grower.

Goupill is charged in the death of 28-year-old Jerald Antonio Ogden of Ypsilanti, who died of a shotgun wound to the back, the Wayne County Medical Examiner's Office said.

Goupill also faces a charge of manufacturing a controlled substance because he was growing more marijuana than legally permitted, Interim Milan Police Chief Jeremy Nieman said.

Police said Goupill and two women were in Goupill's home in the 200 block of Anderson Street in Milan just before midnight Feb 23, when Ogden and another man forced their way inside and stole marijuana. Goupill is accused of chasing the intruders along a path that connects to the Scottsdale Estates subdivision and shooting Ogden. The shooting happened roughly 200 yards from Goupill's home, Nieman said.

Ogden was found dead behind a car in the subdivision on O'Brian Drive, while the other man involved in the home invasion ran away, Nieman said. Police continue to look for that man. He is described as black, 6 feet, 3 inches tall, 185 pounds and in his early 20s, police said.

Has anyone else noticed that almost all of the "social problems" that come from marijuana come pretty much solely from the fact that it's illegal? Last time you heard of a high guy beating his wife and kids? Someone driving high and causing an accident? I'm sure it happens occasionally, but much less often than with a certain legal substance. How about we just legalize marijuana for adults and thereby get rid of 90% of the problems associated with it.

Too many old people that were raised on propaganda are still around and in positions of power. Until they are gone we will continue to have a drug war. Just this morning some congressman fool was on CSPAN saying he does not EVER want cannabis legalization because it leads to people using heroin and meth. Never mind that this gateway drug theory has been debunked and proven as false over and over, it doesn't matter, in this very powerful person's mind cannabis is a gateway drug and no one should ever have it. It's tough to fight that kind of ignorance and get things done, but people are still trying thankfully

True that. It would also get rid of 99% of the problems associated with adulthood. Smoke pot. Better than drinking yourself to death, loading up on Dr prescribed >legal< drugs and inhaling cinnamon to cope with life. I've never had an issue with someone smoking weed. I personally don't partake, but I know plenty of people that should.

The biggest scam going right now is caregivers recruiting patients to list them as their official caregiver, thereby allowing him/her to grow 12 plants for each patient. The caregiver in turn promises to supply the patient with a paltry amount of weed each month for 'free' meanwhile he is selling excess straight to the dispensary or to other non-cardholders for top dollar. I have two friends who both have cards and they worked out this very arrangement with a caregiver, of course it was all very hush-hush, but I'm telling it here to apprise the reader how the game is played in Medical Marijuana Land.

Or we could just keep it all illegal and on the black market and then you will have no clue what is going on with either the buyers or suppliers. The MMJ law is not perfect but it is better than the old "no one can have it" model that you're championing that has been proven for decades to be a complete and utter failure. So yes you're buddy's gaming the system but at least the system is somewhat aware about it! If he was off the radar do you think anything would be different?

and the fool is probably still running!!! The only thing worse for this robbery victim then the rippers coming along is when the police show up to finish the job...I am sure he will be exonerated of the inflated charges involving cannabis.....BUT you cannot shoot some one once they flee your property...Just ask Ty of Detroit...He is in jail until next year though...

Shooting someone in their back while they're running away, it's gonna be hard to claim self defense if you do that, which is too bad for this guy. He had every right to defend himself when they were in his house but when they took off and he starts chasing them shooting his gun is where he went down the wrong track.

Too bad the government stands in the way of normal, upstanding businessmen growing and selling marijuana in professional facilities. No other medication (or legal drug like alcohol or tobacco) comes from gang thugs like this.

Hmm

This old guy doesn't sound like a gang thug to me. If you're talking about the robbers then that's one thing since they are robbers and not cannabis farmers, but if you're talking about the 60 year old man being in a gang I think you are a little wrong about that

It is an odd description. A container makes one think it is in tupperware or something similar, perhaps some of those stroareg bins. I would also note that he had 2/3 of the amount of bottled beer that on my wall at one point in time.

66 containers is kinda vauge. If they were active growing containers he would need 5 patients plus himself to be legal. If they were mason jars for curing, I'm not sure he has broken the law. Curing times vary but until it is cured it is not "usable" so it does not count against the amount under the law- 2.5 oz or 12 plants per.

Hmm

Thu, Mar 8, 2012 : 7:23 p.m.

Usable means cut off the plant and in a dried or drying form. Curing does not factor into the process, if it's off the plant then it's "usable" as far as LEO is concerned

Is that supported by case law? I highly (wink wink) doubt you're going to successfully argue that in court: "Oh hey dude, that pot isn't usable 'cause the smoke isn't as mellow as it'll be in a couple weeks. Right now it's, like, totally harsh man."

as far as Milan piggies are concerned ANY cannabis is illegal....they think Michigan voters are stupid. So does our Attorney General and ALL the Republican Legislators and a few democrats as well. BUT they are gonna fix things for us poor befuddled voter/citizens...Not sure why they let us vote at all...
