Prosecutors dismiss sexual assault charges against Chelsea man
Today's scheduled retrial of a Chelsea man accused of sexually assaulting a minor was abruptly canceled as prosecutors announced they could no longer go forward with the case.
Michael Kohler was to face jury selection again today in Washtenaw County Circuit Court on four counts of first-degree and second-degree criminal sexual conduct.
However, prosecutors dismissed the case late last week for unspecified reasons, records show. Chief Deputy Assistant Prosecutor Steve Hiller said over the weekend that he was aware of the development in the case but could not comment without further details. County offices were closed Monday in honor of President’s Day.
Kohler, 46, has been free since posting $5,000 bond in September. He stood trial in July, but jurors deadlocked after more than seven hours of deliberations. Circuit Judge David Swartz declared a mistrial and initially scheduled the second trial for last month. Attorneys requested the delay after reportedly finding new information that needed to be investigated, records show. Further details were unavailable.
Prosecutors charged Kohler last year after a relative came forward with allegations of abuse dating back to 1997.

Just wait, apparently new information is coming in. It will all come out in the wash.

It would seem the "new information that needed to be investigated" has been investigated.

Mr. Aisner, do you know if the charges were dismissed with, or without, prejudice?
