Dexter Township man found guilty on four indecent exposure counts involving young girls

A jury convicted a 66-year-old Dexter Township man Tuesday on four misdemeanor counts of indecent exposure in a case involving two young girls.

But the jury acquitted Dennis Schwartzenberger on five felony charges, including one count of second-degree criminal sexual conduct, three counts of accosting a child for immoral purposes and one count of aggravated indecent exposure.

Aggravated indecent exposure involves exposing and fondling.

The two girls, ages 8 and 9, testified last week that Schwartzenberger exposed himself to them separately on multiple occasions. One of the girls said Schwartzenberger made her watch a pornographic movie on one occasion and tried to force her to touch his “private parts” several times.

When Assistant Prosecutor Sam Holtz asked one of the girls whether Schwartzenberger had ever done anything to make her uncomfortable, she replied he had “more than 10 times.”

The girls lived near Schwartzenberger at the time and regularly used his pond for fishing and boating. The girls’ parents testified their daughters occasionally played with Schwartzenberger’s grandchildren and went to the pond with their siblings several times per week during summer months.

Defense attorney Michael Vincent said the only children police interviewed were the two girls making the accusations. Vincent also said when a search warrant was executed on the Schwartzenberger home, they found nothing on his computer and no pornographic movies.

One girl testified Schwartzenberger showed her pornographic VHS movies on a VHS cassette tape. She said the cassette had been pulled from a drawer below the VCR, but photos of the basement showed there were no drawers below the television set or VCR.

Police began investigating after one of the girls told her brother about the incidents on June 8, 2009.

Schwartzenberger’s sentencing is scheduled for March 31. He faces up to one year in the Washtenaw County Jail, $1,000 in fines, probation and placement on the sex offender registry.

“We are currently exploring whether or not we are going to file an appeal on the four misdemeanors,” Vincent said.
