Judge grants stay of order to release Hutaree members

The federal government late Monday convinced a judge to delay the release of nine members of the Christian militia group Hutaree.

Earlier Monday, U.S. District Judge Victoria Roberts overturned the April 2 decision of a federal magistrate judge. She said all could be released with electronic monitoring devices and other strict conditions. They were expected to be released Tuesday, the U.S. Marshals Service said.

But U.S. Attorney Barbara McQuade asked for the stay early Monday night, the Detroit Free Press reported. She noted that Hutaree members had plotted to kill police, and referenced the fatal police shooting of a police officer in Detroit.

Prosecutors have until 5 p.m. Wednesday to tell the judge whether they will file an appeal. If prosecutors appeal, Roberts wants a detailed explanation of why they think they can succeed.

The nine members are charged with conspiracy to commit sedition, or rebellion, against the government. Prosecutors say they're too dangerous to be free, but the judge disagreed after holding a two-day hearing last week.

1. They are not a "Christian Militia" That's the lap dogs following the lead of the criminal Southern {Poverty Law Center who have released lists of people they call treasonous... Such as Ron Paul... Etc. Let us not forget how just a few days before the raid that none other than A2.com was running the quotes and talking points of the SPLC as if it/they are a legit org. Hmmm... We heard for days that the main suspect in the NYC failed car bomb was "White Male 50"... White Male.... White Male... The Mayor of NYC, Bloomberg even went so far as to blame it on a Tea Party Member... 2. This group was infiltrated by Fed agents for a long time and it HAS been reported that THAT agent was the person with 'bomb making knowledge and put there for that reason... In other words Agent Provocateur... Hello... Not to mention the seprerate informant, also in the group. It's total BS! 3. It's unbelievable to me, futuremi, that people will believe anything their TV tells them. Wake Up! I hope the funeral for the officer killed in Detroit will be soon. The prosocutors for this group have until 5 PM today to come up with reasons why this group should be released. They have to file an appeal, which means the group will still be in jail for a little while longer. This is one time I appreciate all the contrived delays in prosecuting criminals. I hope there are lots of appeals to prevent this group from being released.

"somehow trying to make their murderous ranting into noble expressions of "free speech" well not an apologist but a realist. "Ranting" however ill conceived IS STLL FREE SPEECH and protected by the 1st Amendement. The contention that the authorities make and that we are still waiting for prooof of is when the speech crossed the line to action. Actions can be illegal and prosecuted. So far no such proof has been shown, only intimation and hype which the judge seemed to agree with. What's with the name calling? Some see a bigger threat at play than a few yokels foaming at the mouth. That you missed or dismissed it does not make it so and all the derisiveness in the world won't make it so. You seem to deride their free speech and that they own guns. Follow your logic to its irrefutable conclusion and what do you get? Far more damage than a few "Rambos" could ever hope to commit. we've got real heroes/grown ups quickly and efficiently sussing out the culprit behind the times square bomb, and their counterparts doing their best to curtail fanatics elsewhere in other trouble spots... and then we have these overgrown babies playing 'bad rambo', and their apologists on this thread somehow trying to make their murderous ranting into noble expressions of "free speech". sheesh! ( and this from a normally pretty liberal guy, who has been enough 'mugged by reality" to recognize that the far right and the far left merge into an indistinguishable mish mash of malice and potential danger that needs judges able to see such threats as trumping the supposed "right' to plot and incite in an age of runaway wackadoodom. glad their release is on hold.

These guys had there chance to spill blood of the government. When the police came knocking on the door. They did nothing not a shot fired or a bomb exploded. These guys like to play in the woods and exercise there rights to play with guns. If they were for real they would be in body bags. Ruby ridge and Waco.

futurmi-Where have you been? Ever listen to rap, the tea party or seen the movie "Capitalism- A love Story. Lots of people in this country are sick of our government.Freedom of speech and "Ploting" are not the same. No detailed plans,no action taken = Talk. If the feds get away with this who will be next? you? Sure- hold them without bail, violate some more rights then tell us again how your protecting us.

Since when can police arrest you for rebellion? Social change is made with rebellion. We rebelled against the British. Women and blacks won Civil Rights and voting rights when they rebelled. Arrest someone for putting together the elements to act out a crime but not to think about it. And since when is thinking about a crime, itself a crime? And since when is talking freely in your group, in your home about rebellious ideas or even a crime, itself a crime? What happend to free speech? When did they create the thought police?

Plot against the Government? You're kidding, right? I remember anti war protesters carrying signs saying "I'm here to kill Bush" for C sakes! And that's ok? Speaking of Bush, I'm glad to hear that these people were charged with having WMD's. With this definition, looks like the Bush administration was absolutly right about IRAQ having them. IED's are now WMD's according to Eric Holder. LOL

Amen, Judge Roberts! Whose police officer brother, sister, son or daughter would we have asked to go pick them up when they did not show up for their court date? To be the first to greet them at the doors of the court after they had been free for a few weeks and had time to have their buddies bring them another AK-47? Not me and not mine.

These people were totally set up by the feds. It has been admitted by AP that the FBI informant, Thomas Piatek, was the one who built the only explosives they have as evidence. (The FBI also built the explosives for the 1993 World Trade Center bombing by the way.) The "informants" are there to entrap people by getting people to incriminate themselves by saying something that can be used against them even if it has to be twisted out of all proportion to fit the scenario they want to paint for them. Were there other Hutaree members really with the FBI as "informants?" As far as I have seen there is no evidence of any crime, just a lot of unsubstantiated accusations and a tape of David Stone giving his opinions and analysis of the dangers faced by the people of the U.S. with his own spiritual tinge. If the feds has anything more I think they would have brought it up. This whole thing stinks of a COINTELPRO/false flag type of psyop on the American people.

futuremi: read Judge Robert's release orders-they did nothing that would prevent their release and the govt has yet to show any evidence they committed any crime. Something about the 1st Amendment...

This group is sick, but, using the Detroit shootings in reference to this is even more sickening. The U.S Attorney should appoligize to the families involved in the shootings.

Was it really a "sick plan," or was it just people spouting off at the mouth and saying terrible things? It seems like the point in having a trial is to determine how far they really had tried to go, and if a Judge who is much closer to the case than you or I ruled that they are unlikely enough to cause trouble, then why would you have cause to think otherwise? I am glad courts don't use the comments section of newspapers to find potential jurors.

I think the missed point here is that it's not illegal to spew hate on the internet for whatever purpose and that the "plot" may have just been more of the same. Fortunately or unfortunately due process and free speech protects everyone, not just those we deem acceptable or politically correct. Denial of same against those we don't like eventually leads to denial for "us" as well.

Its unbelievable to me that you can plot against the government, plot to kill law enforcement officials, spew hate on the internet to promote your group.....and can then get released. I'm all for due process, but this just seems like it gives the group time to regroup and have a second chance to execute their sick plan. Absolutely ridiculous.
