Man stopped by Ypsilanti police indicted on federal gun, drug charges
A man has been indicted on federal charges after Ypsilanti police said they found cocaine in his car and a handgun under the hood during a traffic stop last month, federal court documents say.
Ervin “Oleo” Toliver, 31, of Inkster, is charged with possession of a firearm by a convicted felon and possession with intent to distribute crack cocaine.
Toliver, who has three felony drug convictions, faces a minimum of five years in prison, if convicted. The indictment was filed late Thursday.
Toliver and his attorney, Raymond Burkett, could not be reached for comment today.
Toliver is out on $10,000 bail after being arrested Sept. 29 on a federal criminal complaint.
Ypsilanti police stopped his Cadillac about 7:50 p.m. on Sept. 16 near a traffic light on Maus Avenue, records say. He was pulled over because he wasn’t wearing a seat belt, according to an affidavit from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
Upon being stopped, Toliver began shouting at an officer “Why are you harassing me?” the affidavit says.
The interior of the Cadillac was “littered with pine tree air fresheners” and between 20 and 30 were hanging near the steering wheel, according to the affidavit.
Officers, who were aware that air fresheners are used to mask the odor of narcotics, brought a police dog to the scene, documents say.
Toliver “became very anxious and was sweating profusely,” the affidavit says.
The dog “alerted to the odor of narcotics” and officers searched the vehicle, the affidavit says. They found an off white substance on the driver’s side floorboard, which field tested positive for cocaine, documents say.
When officers told Toliver they were going to search the vehicle, he said, “Alright it is in the arm rest,” according to the affidavit. Officers found several rocks of suspected crack cocaine there, recovering a total of 12 grams, documents say. Investigators looked under the hood and found a loaded Taurus .38 caliber revolver, according to the affidavit.
The gun had been reported stolen out of Inkster, records show.
Toliver was read his Miranda Rights and waived them, telling police the car was his and he bought the drugs in Inkster for about $300, the affidavit says. He hoped to make a $200 profit, documents say.
According to the affidavit, Toliver “denied any knowledge” of the gun.

Two of these he was sentenced on 04/09/2009 under docket 082289-FH here is Washtenaw County. Born 05/02/1978 and his Michigan Department of Corrections number is 696107. Hopefully the feds can do something with him. It is obvious that Probation is not deterring him from selling drugs.

What is this hiding guns in the engine compartment thing? In the recent mother/son shooting that happened in Detroit the gun was stored in the engine compartment too.
