Competency hearing for man accused of killing Dawn Fital delayed

A competency hearing for the man accused of killing Pittsfield Township resident Dawn Fital was delayed Tuesday because the report had not been sent to the lawyers in the case.

Gregory Noack, 44, has been charged with open murder in the death of Fital at the Arbor Knoll apartment complex on Plum Hollow Drive in June. He was back in 14A District Court on Tuesday for the hearing ordered by Chief Judge Kirk Tabbey to determine whether Noack was competent enough to stand trial in the case.

However, Washtenaw County Assistant Prosecutor Brenda Taylor requested the hearing be moved to 1 p.m. Sept. 13 because she had been told that officials in the doctor's office performing Noack's competency tests had not sent in the report. Taylor said she had been told that the reports would be faxed to the court on Sept. 9.

Fital was found dead at 9:13 a.m. June 16 in a suitcase in a retention pond near a Toys 'R' Us store in Merrilville, Ind. Her autopsy report showed she died from asphyxiation and also suffered blunt force trauma to her head.

Police say Noack killed the mother of four in the apartment, where she lived with him and her ex-husband, before putting her in the suitcase and driving to the Indiana town more than 200 miles away. He is being held without bond in Washtenaw County Jail.

Hopefully this case won't drag on through the courts too much longer. I'm sure the family wants to see justice served. My thoughts and prayers of strength go out to Dawns family and friends.

This was such a sad story, I remember well. We can WAIT, just get it right!
