Township calls Jenny's Market straw maze a public nuisance, seeks court order to remove it

A pile of straw bales at Jenny’s Market provides loads of fun for local children who come to visit every year, says Burton Hoey, who runs the popular farm market west of Dexter.

But Webster Township officials say the straw stack, which has three tunnels supported by plywood running through its base, is a safety hazard and a public nuisance. They want it dismantled, and they’re taking Hoey to court to try to force the issue.

“There’s a multitude of risks associated with that,” said Bruce Pindzia, township zoning administrator. “We’re worried about collapse. We’re worried about fire hazard. We’re worried about children being injured.”

The township has filed a complaint in Washtenaw Circuit Court against Hoey and his daughter, Jennifer Lambers, who owns the property at the intersection of Dexter-Pinckney and Island Lake roads. The complaint asks the court to declare the maze a public nuisance under the township’s nuisance ordinance and order it removed.

The township alleges it notified Hoey and Lambers on Sept. 10 that the maze violated the township's nuisance ordinance and asked them to remove it, but they failed to comply.

The complaint alleges that the maze “endangers public health, safety and welfare,” that “there are no escape routes for children trapped within the maze” and no access points for adults and that the maze is “susceptible to collapse under its own weight, possibly while children are inside it.”

Hoey, who has had a protracted dispute with the township over zoning issues, scoffed at the suggestion that what he calls a “haunted straw maze” isn’t safe and said the township is harassing him hoping that he’ll go out of business. “They want me gone. They don’t want Jenny’s Market.”

He said he’s had a similar maze every fall for 15 to 20 years, and the township has never complained about it before.

“Webster Township is using the straw maze as a target to irritate me, and the only ones that are going to lose out is the children,” he said. “Where are you going to have them play? A Walmart parking lot?”

But Pindzia said concern for public safety at the maze was the primary motivation for the filing of the lawsuit.

“It’s so confined that there is not room for adults to access the tunnels,” he said. ”If a child gets trapped in there for whatever reason, the whole mess would have to be deconstructed.”

But Hoey says that’s not true. “I can get through it, and I weigh 220 pounds,” he said.

Fire is also a serious concern, Pindzia said. “There’s a whole apron of loose straw surrounding this thing,” he said. “A single cigarette butt could ignite this thing.”

He acknowledged the maze was unlikely to go up in a ball of fire, but he said smoke inhalation could be a real danger to children in the maze if a fire broke out.

Hoey countered that he keeps a hose and fire extinguisher nearby. And he said the straw is wet from recent rains and not likely to burn.

The township also alleges Hoey has not allowed officials to inspect the maze, a claim Hoey disputes. He said the township’s building inspector has been out several times and seen the straw stack and the tunnels. He also said he has no authority to keep Pindzia from inspecting the maze and hasn’t tried to.

Hoey said the maze is popular with visitors to the market who bring their children and grandchildren.

Rosemary Schuett of Dexter is one such visitor. She said she often brings her three grandchildren to the market and said she has no concerns about the safety of the maze or the market as a whole.

“I don’t think it’s any less safe than the playground equipment that I let my grandchildren use at the various parks,” she said. She also disputed the township’s claim that the maze is not large enough for an adult. She’s been through it herself, she said.

The dispute over the maze is the latest in a string of problems for the market that began last September when a hayride accident paralyzed an employee. The employee, Mary Armbruster, has sued over the incident.

The day after the accident, Webster Township delivered a stop-work order to the market alleging violations of zoning ordinances. Shortly afterward, the state of Michigan found several food safety violations at the market.

In late October, Hoey reported that two men attacked him at the market and stole several months worth of proceeds at the business. Washtenaw County sheriff’s deputies have dropped their investigation of the attack, saying Hoey wasn't cooperating and had failed a polygraph test.

Hoey sued the township in April over its refusal to grant him a permit to install a bathroom. In denying the permit, township officials said Hoey had failed to submit a required site plan. Hoey and the township had been working toward a settlement, but progress recently stalled.

Last month, the Humane Society of Huron Valley seized horses, donkeys and goats at the market, saying they had been neglected. That case remains unresolved.

A court hearing has been set for Oct. 18 in the latest dispute. Hoey vowed to prevail. “I’ll win. There’s no question about it,” he said.

The greatest crime committed is allowing Jenny's Market to stay open as long as it has. This is not a farmer's market, Burton Hoey does not even own or operate a farm, he buys his "homegrown" produce from the city. If parents feel comfortable allowing their children to crawl around in tunnels of water-logged, bug and mold infested straw, that's their decision to make. But having a laundry list of health and safety violations, lawsuits, and the tragedy of a paralyzed young woman who Burton Hoey has 100% neglected to help following the injury caused by his negligence, lacking insurance for "part-time" staff when all that he employs are part-time, seasonal workers, is reason enough for a witch hunt. If there is any justice to be found, it will be a witch hunt followed by a firm prosecution. It disgusts me that so many parents bring their children here, thinking they are providing the wholesome experience of small town, charming farm life, though turning a blind eye to the well documented cases of animal abuse. Deliberate, inhumane, violent animal abuse. This man has had many animals taken away from him for legitimate cases of abuse and neglect. Think hammer to horse skull. But don't take away the mushy pile of hay bales, you cry? Don't take away the facade of a genuine farm experience? The man is a crook and has been playing the victim for decades, he has never felt he should have to follow any of the rules, and not just petty rules, but ones that any other local farm market abides by without even being told to, because they have the common sense and feeling of responsibility that a man like Burton Hoey lacks. People come from all over Washtenaw and Jackson county come to this market and many probably stop in Dexter for food or gas afterward. Read the above comment: Years ago my 10-year-old fell right through the top. The maze was packed with kids crawling around inside. It's just chance that he didn't land on another kid's neck or head. That was our last visit to the maze. I also believe it's a huge fire waiting to happen. It would ignite so fast, I believe a lot of kids wouldn't be able to get out of the tunnels in time. I hope the hose they always keep nearby is connected to a fire truck. YouTube has lots of hay fires, btw.

Hoey's awful roadside attraction is in the news often because it is poorly run, unsafe, and Hoey is always full of hot air and a good quote (even though he seems to be lying or bending the truth most of the time...) I really enjoy the updates on Jenny's....

We moved to Dexter 4 years ago and live less than a mile from Jenny's. At first we supported them, but over the years it has been one bad incident after another. Last year I took my young son to the straw maze/pile and I did not feel it was safe so this year we are not going back. I agree with all the concerns others have posted about safety, traffic, and upkeep. I mentioned to some of our neighbors that we no longer go there and it was a chorus of "oh, we haven't gone there for years!" So I do agree that most of the supporters are probably from out of town or new to Dexter. I don't know anyone who has lived in Dexter for more than a couple years who would shed a tear to see the place close down. My biggest problem is with Mr. Hoey who just seems so full of himself and fails to take any responsibility for anything. Every quote from him is along the lines of "poor me, they're out to get me." Well, run your business properly with an eye to customer service, ethics, and safety and then no one would be out go get you.

The Basic Speed Law and Prima Facie Speed Limits The Michigan Vehicle Code states that at the most basic level a "person operating a vehicle on a highway shall operate that vehicle at a careful and prudent speed not greater than nor less than is reasonable and proper". The Vehicle Code places responsibility on the driver to be diligent and aware of their surrounding while being fully in control of their vehicle at all times. The Michigan Vehicle Code establishes the maximum speed limit on all highways as 55 mph. Prima facie reductions to this maximum speed include 25 mph in business districts, 25 mph on platted subdivision streets, and 15 mph in mobile home parks; these prima facie speeds do not need to be posted speed limits. Other prima facie speed reductions are based on access point density. Prima facie speed reductions on the basis of accesses points require the speed limit to be posted on the roadway. You mean Webster Township - not Dexter. I have to say there are other businesses who have said the Township is heavy handed and somewhat unreasonable towards businesses but are too worried about what is happening to Burton (however deserved) to speak up about their own treatment.

Maybe Mr. Hoey isn't as dishonest as the township would like everyone to think...sounds like the township has an alternative motive. Sounds like a lynch mob!

A girl is paralyzed due to his neglect, he had no insurance that covered part time workers, even though all his employees are part time/seasonal workers. There is a list of violations he has failed to recognize and correct, common sense things, because he doesn't think any rules apply to him. This is nothing new, it has been going on for decades.

OK. The guy has certainly been involved in a few things that could certainly be defined as 'unsavory' but this sounds like some officials have simply placed a target on his back. The idea is to get him (and others in similar circumstances) to comply with zoning and safety regulations. Not put him completely out of business.

Mr. Hoey is obviously sitting back and laughing about all of the folks defending him on here. The whole operation is decrepit and dangerous. Ms. Armbruster's paralyzing accident should never have happened. The animals should not be mistreated. The traffic problems should not be tolerated. The food should not be unsafe. The building laws should not be ignored. People who have not lived in the area long or come here from out of town seem to be the ones who support this business and defend it. I'm sure many folks like a place to bring children despite safety concerns. Mr. Hoey's comments and actions over the years speak for themselves.

No Laura, they are not wrong for wanting to shut the straw maze down. It creates a hazard. It would be called an "attractive nuisance" in legal terms though it becomes less attractive by the day. When a child does end up dead in the road, or smothered in the straw, will you still feel sorry for this man. Will you blame the government for not doing something about it. You do notice that none of the other fall venues are replicating his straw maze don't you? They don't want the liability or the possibility of children getting hurt. He, on the other hand doesn't care. He only wants the income. That intersection is one of the busiest in western Washtenaw County and no place for this type of "business". I will not get on Burton's Pity Train with the rest of you.

Ok, since it seems to matter to you, let me start by saying I have lived in Dexter for over 20 years. Now that we have that out of the way: The point is not that Burton doesn't have problems that should be addressed. The point is that the hay maze is not one of those problems, Legitimate issues are well worth pursuing, This simply is not one of them. Period. It matters very much that any government does not resort to harassing someone or think that they can do so without the glaring light of public opinion. This time its Burton, who is an easy target and hard to defend, but next time, it could be you. What then? Wrong is wrong, even when done against a jerk.

The biggest nuisance in this story seem to be the township. They've got it out for this guy and have had it out for him ever since the young lady was hurt on the hayride. What if a corn maze caught on fire like the one off of Mast Road? Dry corn can burn too. The collapse theory is another over reach and they'll probably require him to have a structural engineer analyze it for thousands of dollars. What's next America? If we all sit by silently you'll have to wear a helmet to walk down the street some day and full body protection in case you get hit by a car or meteor..........

I'm sure the township is trying to avoid another tragedy. No one could have predicted the accident that happened last year, and the township is now vulnerable. If something horrible should happen, the parents would be wondering why the township didn't monitor him more closely. I lived for years down the street from him, and both my daughter's worked for him. I've heard a lot of stories about his business practices. Let's just say I don't go there.

Guess the Township should next outlaw all trees and the climbing in them by children. They certainly are more dangerous than this straw amaze. I live in Dexter, and for years have watched thousands of children enjoying this safely built maze. They love it and it is safier than most other things that children play on/in. Even at 230 pounds, I have laughingly gone through this maze, enjoying every moment of my adventure. People should climb on Burton's band wagon and congratulate him for keeping "some of the nice traditions of the 'good old days' alive". The local police , township and Humane Society seem to have a vendatta against Burton and Jenny's Market. Is it because everything he does is so "illegal" or is it because Burton fights back against many of their foolish demands? Let's start to control those things that really are dangerous. This straw amze is not one of them!

I wonder how many of the posters here in favor of Hoey's wouldn't be bashing the township if something did happen with the maze and would be saying 'why didn't the township do something to have prevented this?'. Hoey's got signs up at several road junctions in neighboring townships right underneath the stop signs - nice distraction to drivers. And illegal. He just ignores rules and does what he feels like. Just read the long list of past incidents and it's easy to see what happens when he chooses to ignore common sense and laws. What will happen next and who will be hurt?

I'll start with #1. It does not have the potential to contain a hazardous atmosphere. So, it is not a confined space. A confined space is like going down a manhole where the air can be contaminated. Requires testing to make sure the air is not "poisoned" before entering. That is certainly not going to be the case unless it is already on fire. That would mean any structure that has the potential to burn is a confined space. #2 - Engulfed by straw? #3 - There are several exits. Again, unless the entire thing collapses which is I suppose is the point that is being argued here. #4 - no claim of any other hazards contained within. SO, while I don't blame you for not trusting his engineering expertise, this is not a fair application of confined space.

Stand there some time and figure out how long it will take you to get to your kid if it collapses, when at the same time all the other parents are climbing all over it to get tho their kids, and throwing straw from the hole they're trying to dig into the hole you're trying to dig? Think about it - what is the rain doing to the plywood over time? How much weight is the plywood holding, especially once the bales of straw take on moisture and 50 kids on top of them? It's not a place I really go to, but this is not the issue that should break the camel's back. The straw maze? Really? I drive by there several times a week. I think whole operation is a hazard and an accident waiting to happen. Sight distance is very limited. There are little kids very close to the road. It scares me every time I drive by. I believe in the free market and own a small business. So I don't like big government controlling everything (as it is wont to do). I started driving tractors when I was 6 years old and would do it again, so I am not scared of my shadow. But there is a place for public safety to play a role. And if there was ever a place that some concern for public safety, this is it. Some of the comments on this article might change if a 3 year old is run down by a car. Every year I expect to see that in the paper.

Could a car enter the area by accident - sure. Same thing could happen on the sidewalk in town too. The problems with that corner have more to do with the city fathers refusing to create a by-pass, despite reports years ago telling us that there would be more traffic than the train viaduct could handle. I have lived in the area for years and travel Island Lake Rd. almost daily. It has been a nuisance since day one, mainly in the fall. Other times of the year aren't quite so bad. There is not enough off-street parking, so in the fall people park along the sides of Island Lake and Dexter-Pinckney Rds. They step into the street to get into/out of vehicles. People fly through that intersection and the speed limit is 55 mph on Island Lake Rd. at that point (it is unposted after the intersection). I am honestly surprised someone has never been killed along there. There are little children everywhere and no fences. For years, he drove the horse-drawn hay "wagons" on Island Lake Road oblivious to vehicle traffic. I cannot wait for Halloween to be over every year so the craziness will end. I'm willing to bet the majority of people who frequent that place come from out of town and have no idea of the history surrounding it. Too bad.

Those were entirely different straw bales. Hoey's straw bales weigh app. 40 to 55 pounds each not 1 ton bales . Which suggest they were the big round bales. I don't know if Hoey has no smoking signs around the maze or not but MOST people would be smart enough not to be smoking around straw or any farm buildinds .

Jenny's could be a great place for families this time of year, and I suspect that it probably once was a nice little place to get a pumpkin, sip cider, and watch the kids scamper through the hay bales. But these days Jenny's is a sad mess. Most of the structures on the property are in an advanced state of decay, held together by nothing more than layers of hastily applied yellow paint. Everywhere you see rotting rails and boards wired together, junk heaped up out back of the main building, and just an accumulated filthiness that cannot be painted over or easily shoveled away.

With all due respect in return, please note that if the hay maze is a symptom, them Jenny's Market is just fine. Doesn't seem to me your argument holds water when one looks at the facts. If the business is on the decline for legal reasons, it needs to be dealt with on actual issues - not ones pulled out of the air. The chicken coop, the animals, those were legitimate issues. This is most certainly not. Further more, it sets a very bad precedent. Wave goodbye to any more hay mazes in the township if this prosecution goes forward. The township has gone over the edge here from legitimate investigation to petty fiction.

Mr Hoey has a LONG history of ignoring rules. Every other business owner in the area has to abide by regulations and ordinances to stay in business. Hoeys list of violations is quite long, he cannot even submit a simple drawing of his layout for permit applications. One of his ex-employees is paralyzed because of lax safety standards, it is likely that the taxpayers will be the ones footing the bills she will incur throughout her life. Alexanders Farm Market does not seem to have the issues Hoey does. Mr Hoey is not a victim, he is another accident waiting to happen, IMHO.

Is the Township unfairly targeting Mr. Hoey and his operation? I can't tell. But it sure seems that this business is in the news often. Vigilance and enforcement are good, but they need to be uniform.

I have taken my children to this maze every year for 8 years. I grew up on a farm. The maze is entirely accessible to adults, and indeed adults are constantly going into it. I am a large man and go in every year. There are multiple exits, and they are available from the central hub of the maze. This is *not* a maze. It has three or four tunnels leading to a central space. It is impossible for that maze to collapse as built. It is built of bales of straw and bales of that type have incredible structural strength. In addition the straw is supported by heavy posts, and heavy plywood. Straw in that configuration burns badly. I have seen it. It is a slow moving fire with lots of fragrant smoke. The bales simply will not burn. They might smolder. The point is that there would be a lot of time to evacuate the children, plenty of exits for them, plenty of room for adults to go in and check, and no place inside to hide nor get lost.

Maybe he should build it to be safer, or relocate it to another area. If it's for the benefit of the kids, taking one look at it will tell anyone with common sense that it is a poorly constructed pile of watersoaked hay. Considering he has had it up for "15 to 20 years", why not make a little investment to have the tunnels larger? It's 2X4s and hay bales, how much would it really cost a real "farmer" to construct something a bit better?
