Lawyer seeks mental examination for Andrew Shirvell

Lawyer Deborah Gordon has asked a judge to order a mental examination for former assistant state attorney general Andrew Shirvell, the Detroit Free Press reported.

In a court filing, Gordon sought the examination to show that Shirvell is “a disturbed young man who needs counseling,” the newspaper reported.

Shivell filed a defamation lawsuit in October 2011 against Gordon, who represented former University of Michigan student body President Chris Armstrong. Armstrong recently won a $4.5 million judgment against Shirvell. Armstrong’s suit alleged Shirvell stalked him and caused emotional distress in 2010 with posts on an anti-gay blog Shirvell wrote and on Facebook.

Shirvell alleges that Gordan is trying to “harass” and “intimidate” him into dropping the lawsuit, the Free Press reported. He wrote that he believes he will prevail in the lawsuit against Gordon and on appeal of the recent judgment against him, according to the article.

Shirvell was fired in 2010 after criticizing Armstrong on his blog, in Facebook posts and during visits to the Ann Arbor campus. A judge dismissed a lawsuit Shirvell filed against Armstrong alleging the student had defamed him.

Hmmmm, Gordon is an officer of the court. If she has stated for the record that "he was "troubled and immature young man" and "seems to be delusional" then she filed a knowingly false case in Federal court. If Shirvell is delusional, he is a victim of a psychosis, and cannot be held as liable for defamation. Gordon lied to the court. Shirvell's attorney should file a motion to dismiss and should also file a complaint with the bar association. Methinks Gordon hath complained too much.

Ann Arbor has so many fun things going on during the weekend, yet Shrivell chose to spend his Saturday nights stalking the openly gay student body president. Reminds me of a guy I say in Milwaukee, WI, who chose to spend a beautiful summer Saturday afternoon holding a sign on a freeway overpass that said, "homosexuality is a sin." People as outwardly homophobic as Shrivell are usually trying to hide from themselves.

Of course Lawyer Andrew is a "Legend in his Own Mind." On the other hand D. Gordon is an Old Law Dog and should know better than to mess with Andrew who has a valid law license and can burn her butt. He will take her up-and-down thru the appellate courts. Much ado about nothing. Simply stated: it is S-T-U-P-I-D for D. Gordon to play the "Insanity Card." D. Gordon: Get a Life!

If Andrew Shirvell's mental state is in controversy, Deborah Gordon has the right to seek a psychiatric examination to explore that issue. If Gordon has published statements that make adverse reference to Shirvell's mental state that Shirvell alleges are slanderous, then Shirvell's mental state is in controversy to the extent that Shirvell contends her statement are false. The results of such an examination are relevant to the truth or falsity of Gordon's alleged statements. If Shirvell does not want to submit to such an examination, the judge can dismiss his case.

libel or slander, he would have to prove specific damages...and that is really hard to do when you behave similar to a lunatic in public so much for so long. The idea that he thinks he'll win is the crazy part in my humble opinion.
